Article 2 : THE SITE - PRODUCTS - AVAILABILITY

The entire content of the Site (illustrations, texts, labels, brands, images, videos) is the property of Nerina Bijoux. Any reproduction, in whole or in part, of this site is prohibited, except with the express and prior authorization of Nerina Bijoux. The boutique Nerina Bijoux does not authorize the creation of hypertext links except with the express prior consent of Nerina Bijoux.

The products offered for sale by Nerina Bijoux are presented and detailed in such a way that all consumers are able to know the essential characteristics of the products they wish to purchase, in particular by means of technical descriptions from its partners and suppliers and photographs illustrating the products.

In the event that one of the products ordered is not available during the preparation of the Customer's order, Nerina Bijoux will contact the Customer by email as soon as possible from the date of the order in order to propose a replacement product or to cancel and reimburse the missing product of the order at the Customer's request.

The unavailable product will be reimbursed no later than fifteen (15) days following receipt of the sums paid by the Customer. The refund will be made to the Customer's paypal account or by cheque. The cancellation of the product order and its reimbursement will not affect the rest of the order, which will remain firm and definitive.

Article 3 : ORDERS

The Customer shall place an order in accordance with the instructions given on the Site. The Customer undertakes to fill in the registration and order form in such a way as to ensure that the necessary information is complete and accurate. In any event, the Customer is responsible for the information entered on the registration form and when placing the order. In the event of an error, Nerina Bijoux cannot be held responsible for shortcomings or delays in the delivery of products and services (address errors, name errors, etc.).

The steps to complete the sale on the Site are as follows:

In any case, Nerina Bijoux reserves the right not to satisfy any request of the Customer which would be exorbitant or derogatory to the common law and to its general conditions or when the Customer would not be up to date with its obligations towards Nerina Bijoux.

Article 4 : PRIX ET PAIEMENT

The sale prices of the products mentioned on the Site are indicated in euros, all taxes included, excluding shipping costs.

Their amount is in any case indicated at the end of the online order, before its validation. The price invoiced to the Customer is the price specified on the order confirmation, including the price of the products inclusive of all taxes, to which is added the possible price of transport.

The costs are determined according to the amount of the order.

Nerina Bijoux reserves the right to modify its selling prices at any time. However, no modification subsequent to the order will be applied. The price applicable to the products ordered is the one appearing on the Site on the day of the order.

Orders are payable in euros, in full and in cash. At no time may the sums paid be considered as deposits or advance payments.

The amount of the order will be debited when the order is confirmed.

As soon as the payment has been validated, the Customer receives confirmation of the order by e-mail, together with the invoice.

Nerina Bijoux retains full ownership of the products sold until full payment of all sums due under the Customer's order.

Article 5 : SHIPPING - DELIVERY - RECEPTION - USE OF PRODUCTS

Products are dispatched to the address given by the Customer when the order is placed. Dispatch takes place within 24 to 48 working hours. 

The delivery is considered to have been made by Nerina Bijoux when the products ordered are given to the Customer by the carrier. Then, the risks of the products are immediately transferred to the Customer.

For deliveries in France, after shipment, Nerina Bijoux gives the Customer a tracking number so that he can follow the routing of his tracked letter.

It is the responsibility of the Customer to verify the condition of the packaging and the products and the number of products upon receipt. This check is considered to have been carried out on the first day of receipt at the Customer's premises.

It is up to the Customer in case of dispute, deterioration of the product during transport, damage, shortage or delay, to contact the customer service of Nerina Bijoux as soon as possible.

Any complaint formulated late could potentially prevent the taking into account of this complaint (maximum delay of 14 days from the date of reception).

In any case, Nerina Bijoux cannot be held responsible for any delay or default in delivery due to a case of force majeure or a fault of the Customer.

The delivery times indicated by La Poste are indicative and are estimated from the day of shipment. The site Nerina Bijoux cannot be held responsible for any delay in delivery beyond its control.

Article 6 : RETURNS, LIABILITIES AND GUARANTEES

We accept returns within the 14-day cooling-off period. Products must be returned in perfect condition and in their original packaging. The return will give rise, depending on the case, to a replacement of the products or a refund to the Customer, after verification of the quality and quantity of the products returned.

There is no guarantee against breakage if the jewellery is used outside the 14-day period after receipt.

The costs and risks of shipping and return will be borne by the Customer.

Any item purchased using a voucher or discount voucher may only be reimbursed in the same form.

Article 7 : FORCE MAJEURE

In the hypothesis of the occurrence of a case of force majeure preventing the execution of its obligations by Nerina Bijoux, the contract will be immediately suspended, from the notification of one of the parties given by any means. In the same way, the party concerned will inform the other party of the cessation of this event and the execution of the contract will then resume immediately on the date of this notification. Force majeure is defined as any event that makes the performance of an obligation either impossible or manifestly more difficult due to the unforeseeable, irresistible or external nature of the event, these three criteria being alternative, such as war, riots, fire, flooding, total or partial strikes, paralysis of road or other transport routes, disruption of energy supplies (EDF, GDF, oil, etc.), blockages of telecommunications and telecommunications networks, etc., or any other event that makes the performance of an obligation impossible or manifestly more difficult due to the unforeseeable, irresistible or external nature of the event, these three criteria being alternative, such as war, riots, fire, flooding, total or partial strikes, paralysis of road or other transport routes, disruption of telecommunications and telecommunications networks, etc. ), telecommunications and computer network blockages, changes in regulations, delays or failures in the intervention of external partners such as suppliers or subcontractors. as well as any other event considered by law or jurisprudence as a case of force majeure.

If such an event continues for more than fifteen (15) days after the date of notification, the contract will be considered terminated by operation of law. The sums received by Nerina Bijoux before this date will then be reimbursed to the Customer. 

Article 8 : OBLIGATIONS OF THE CUSTOMER

The Customer agrees to communicate to Nerina Bijoux all the elements necessary for the proper execution of the orders. In this respect, the Customer remains responsible for the content and accuracy of the information that it transmits to Nerina Bijoux.

Article 9 : INFORMATION TECHNOLOGY AND FREEDOMS

Nerina Bijoux collects, records, changes, uses and transmits the personal data of the Customers within the framework of the execution of the orders placed, the Customer relations, the advice and Customer services as well as for the preservation of the commercial interests of Nerina Bijoux, in particular for the needs of preserving proof. Insofar as it is necessary for the execution of Nerina Bijoux's obligations, Nerina Bijoux transmits personal information to third parties, for example the carrier.

The Customer has a right of access, modification, rectification and deletion of data concerning him in accordance with the French law "Informatique et Libertés" N°78-17 of 6 January 1978. To exercise this right, it is sufficient to contact Nerina Bijoux at the coordinates mentioned herein.

The Customer may in any case oppose the use of his personal data. The use of personal information for other purposes will only be possible when the Customer has given his consent.

Article 10 : APPLICABLE LAW

The Parties agree that these conditions and their consequences are subject to French law. The language of these conditions and of relations between the Parties is French.

Article 11 : SETTLEMENT OF DISPUTES

The Consumer Customer declares that he/she has been informed in advance by Nerina Bijoux of the possibility of having recourse, in the event of a dispute, to a conventional mediation procedure or to any other alternative dispute resolution method.

In the event of a dispute with the company Alma, you may appeal to the AFEPAME consumer mediator.
