The present general conditions constitute a distance selling contract, defining the rights and obligations of the boutique Nerina Bijoux and the Customer within the framework of the sale of the products referenced on the website www.nerinabijoux.fr.
They relate only to purchases made by buyers in France and delivered exclusively on French territory, the regulations applicable to distance selling.
The present conditions are concluded between the online store Nerina Bijoux, hereinafter referred to as "Nerina Bijoux", and any person wishing to make a purchase, hereinafter referred to as the "Customer", through the website www.nerinabijoux.fr hereinafter referred to as the "Site".
The Customers are consumers, defined as natural persons acting for private purposes or for purposes that are not part of a commercial, industrial, artisanal or liberal activity, who wish to make a purchase on the Site.
The validation by the Customer of an order implies his acceptance of the present conditions.
These general conditions of sale may be modified at any time and without notice by Nerina Bijoux, being then applicable to all orders following such modification. Nerina Bijoux may be obliged to modify from time to time certain provisions of its general conditions of sale, so the Customer is advised to reread them before each order validation.

Article 2: THE SITE - PRODUCTS - AVAILABILITY
The whole content of the Site (illustrations, texts, labels, brands, images, videos) is the property of Nerina Bijoux. Any reproduction of this site, in whole or in part, is forbidden, except if the company Nerina Bijoux gives its express and prior authorization. The Nerina Bijoux store does not authorize the creation of hypertext links except with the express and prior agreement.
The products offered for sale by Nerina Bijoux are presented and detailed in such a way that any consumer is able to know the essential characteristics of the products he would like to buy, notably by means of technical descriptions from its partners and suppliers and photographs illustrating the products.
Consequently, the responsibility of Nerina Bijoux cannot be engaged when the possible errors do not affect the essential characteristics of the product.
The photographs, the illustrations and the texts appearing on the site are not contractual.
The products are new products. They are offered for sale within the limit of available stocks and the possibilities of supply from the suppliers of Nerina Bijoux.
The availability of the products will be definitively validated at the time of the confirmation of the shipment of the order which will be sent to the Customer by e-mail.
In the event that one of the ordered products is not available during the preparation of the Customer's order, Nerina Bijoux commits to contact the Customer by e-mail as soon as possible from the date of his order in order to propose a replacement product or to cancel and refund the missing product of his order at the Customer's request.
The reimbursement of the unavailable product will be made at the latest within fifteen (15) days following the collection of the amounts paid by the Customer. The refund will be made to the Customer's paypal account or by bank check. The cancellation of the order of the product and its refund will not affect the rest of the order, which will remain firm and final.
Article 3 : ORDERS
The Customer shall place an order in accordance with the indications given on the Site. The Customer undertakes to fill in the registration and order form, ensuring that the necessary information is complete and accurate. In any case, the Customer is responsible for the information entered on the registration form and when placing the order. In case of error, Nerina Bijoux cannot be held responsible for the lacks or delays generated in the delivery of the products and services (error of address, on the name, ...)
The steps to conclude the sale on the Site are the following:
The Customer selects his products
The Customer chooses the quantity of products and then clicks on the "Add to cart" button
The Customer then clicks on the "My cart" tab and confirms his order by clicking on the "Confirm order" tab
If the Customer is registered, he/she identifies himself/herself by filling in his/her login and password
If he is not yet registered, he must create an account
The Customer chooses his delivery address and his billing address
The Customer chooses the shipping method and takes note of the possible cost of the latter. He accepts the present general conditions of sale
The Customer clicks on the "Next" tab
The Customer chooses his payment method, proceeds to the payment and confirms his order
Once the order is validated, the Customer can print a summary of his order, which he will receive by e-mail. This document must be kept, it constitutes proof of the Customer's order and of the contract binding the parties.
In any case, Nerina Bijoux reserves the right not to satisfy any request of the Customer that would be exorbitant or derogatory to the common law and to its general conditions or when the Customer would not be up to date with his obligations towards Nerina Bijoux.
Article 4: PRICE and PAYMENT
The selling prices of the products mentioned on the Site are indicated in euros, all taxes included, excluding transport costs.
Their amount is in any case indicated at the end of the online order, before its validation. The price invoiced to the Customer is the price specified on the order confirmation, including the price of the products including all taxes, plus the possible price of transport.
The costs are determined according to the amount of the order.
Nerina Bijoux reserves the right to modify its selling prices at any time. Nevertheless, no modification subsequent to the taking of the order can be applied. The price applicable to the ordered products is the one appearing on the Site at the day of the order.
Orders are payable in euros, in full and in cash. At no time can the sums paid be considered as deposits or down payments.
The payment is made either :

The amount of the order will be debited at the time of confirmation
Article 5 : SHIPMENT - DELIVERY - RECEPTION - USE OF PRODUCTS
The shipment is made to the address mentioned by the Customer when ordering. The shipment is made within 24 to 48 hours.
The delivery is considered to be done by Nerina Bijoux when the products ordered are given to the Customer by the carrier. Then, the risks of the products are immediately transferred to the Customer.
For the deliveries in France, after shipment, Nerina Bijoux gives the Customer a tracking number so that he can follow the routing of his followed letter.
It is up to the Customer to verify the state of the packaging and the products and the number of products upon reception. This verification is considered to be carried out from the first day of receipt at the Customer's premises.
It is up to the Customer in case of dispute, of deterioration of the product during the transport, of damage, of missing or of delay, to contact as soon as possible the customer service of Nerina Bijoux.
Any claim formulated late could potentially prevent the taking into account of this claim (maximum delay of 14 days from the date of reception).
In any case, Nerina Bijoux cannot be held responsible for any delay or defect of delivery due to a case of force majeure or to a fault of the Customer.
The delivery times indicated by La Poste are for information purposes only and are estimated from the day of shipment. The site Nerina Bijoux cannot be held responsible for any delay of delivery independent of its will.
Article 6: RETURNS, RESPONSIBILITIES AND GUARANTEES
We accept the returns within the framework of the right to the 14 days retraction period. The products must be returned in perfect condition and in their original packaging. The return will give rise, according to the case, to a replacement of the products or to a refund of the Customer, after qualitative and quantitative checking of the returned products.
There is no guarantee against breakage in case of use of the jewel outside the 14 days after receipt.
The costs and risks of shipping and return will be charged to the Customer.
Any item purchased with a voucher will only be refunded in the same form.
Article 7: FORCE MAJEURE
In the hypothesis of the occurrence of a case of force majeure preventing the execution of its obligations by Nerina Bijoux, the contract will be immediately suspended, as from the notification of one of the parties given by any means. In the same way, the concerned party will inform the other party of the cessation of this event and the execution of the contract will then resume immediately at the date of this notification. Force majeure is defined as any event that makes it either impossible or obviously more difficult to perform an obligation due to the unforeseeable or irresistible or external nature of this event, these three criteria being alternative, such as wars, riots, fires, floods, total or partial strikes, paralysis of road or other transport routes, disruption of energy supply (EDF, GDF, Oil ...), blockages of telecommunications and telecommunications networks, etc. ), blockages of telecommunications and computer networks, changes in regulations, delays or failure in the intervention of external partners such as suppliers or subcontractors. ... as well as any other event considered by the law or jurisprudence as a case of force majeure.
If such an event were to continue beyond fifteen (15) days after the date of notification, the contract will be considered terminated by right. The sums received by Nerina Bijoux before this date will then be refunded to the Customer.
Article 8: OBLIGATIONS OF THE CUSTOMER
The Customer commits himself to communicate to Nerina Bijoux all the elements necessary for the good execution of the orders. In this respect, the Customer remains responsible for the content and the accuracy of the information he transmits to Nerina Bijoux.
Article 9: DATA PROTECTION AND FREEDOMS
Nerina Bijoux collects, records, changes, uses and transmits personal data of the Customers in the framework of the execution of the orders placed, the Customer relations, the advice and Customer services as well as for the preservation of the commercial interests of Nerina Bijoux, in particular for the needs of preservation of proof. Insofar as it is necessary for the execution of Nerina Bijoux's obligations, Nerina Bijoux transmits personal information to third parties, for example the carrier.
The Customer has the right to access, modify, rectify and delete data concerning him/her in accordance with the French law "Informatique et Libertés" N°78-17 of January 6, 1978. To exercise this right, the Customer has to contact Nerina Bijoux at the address mentioned in the present document.
The Customer can in any case oppose the use of his personal data. The use of personal information for other purposes will only be possible when the Customer has given his consent.
Article 10 : APPLICABLE LAW
The Parties agree that the present conditions and their consequences are subject to French law. The language of these terms and conditions and of the relations between the Parties is French.
Article 11 : SETTLEMENT OF DISPUTES
The consumer customer declares to have been informed beforehand by Nerina Bijoux, of the possibility to resort, in case of dispute, to a conventional mediation procedure or to any other alternative way of settling disputes.
